I believe that you and the courts are really overthinking this topic. There are many millions of Americans who are not allowed to be the President (in fact more than half of our total population is ineligible to be President).
There are at least five conditions that are spelled out that disqualify someone from being the President:
- You can't be the President if you are not a natural born citizen.
- You can't be the President if you are under 35 years old.
- You can't be the President unless you have been a resident within the US for at least 14 years.
- You can't be the President (the President is absolutely an "Officer") if you have "engaged in an insurrection or rebellion against [the Constitution of the United States] or given aid or comfort to the enemies thereof." Any honest and reasonable person would conclude with 100% certainty that Trump engaged in insurrection or rebellion and gave aid and comfort to the enemies of the Constitution.
- And of course, you can’t be President again if you have already been the President for two terms.
No matter how many people would like to elect Arnold Schwarzenegger, Kelsea Ballerini, any of the AGT judges, Barack Obama or Donald Trump --- none of them are eligible to be President according to the US Constitution as Amended. It is simple --- Trump is just one of many who are not allowed to be President. If the courts decide that the law does not matter, and Trump can run because he is popular with certain voters, then Democrats should run Obama who is also very popular and would win in a landslide.
